Pastel is a B2B sales intelligence and lead generation platform. We monitor real-time social intent signals across various public social networks and provide our users with aggregated, enriched data to facilitate targeted B2B outreach.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without notice or liability.

3. User Accounts & Security

To access certain features, you may be required to register for an account. You agree to:

  • Provide accurate, current, and complete information during registration.
  • Maintain the security and confidentiality of your login credentials.
  • Take full responsibility for all activities that occur under your account.
  • Notify us immediately of any unauthorized access or use of your account.

4. Acceptable Use Policy

You agree to use the Service only for lawful B2B sales and marketing purposes. You strictly agree NOT to:

  • Use the data provided by Pastel to send unsolicited, abusive, or non-compliant communications (spam).
  • Violate any applicable laws, including data protection and privacy regulations (e.g., GDPR, CCPA) when contacting prospects.
  • Scrape, reverse engineer, or attempt to extract the underlying code or proprietary algorithms of the Pastel platform.
  • Resell, sublicense, or distribute the data obtained from Pastel to third parties.

5. Intellectual Property Rights

The Service, including its original content, features, algorithms, and design, are owned by PASTEL SASU and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain all rights to any proprietary data you upload to the platform (e.g., your CRM data). You grant us a limited license to process this data solely to provide the Service to you.

6. Subscription, Fees, and Payment

Access to certain premium features of Pastel requires a paid subscription.

  • Billing: Fees are billed in advance on a recurring basis (monthly or annually).
  • Taxes: All fees are exclusive of applicable taxes, which will be added to your invoice as required by law.
  • Refunds: Subscriptions are non-refundable unless otherwise required by law.

Detailed service-specific provisions regarding usage limits and exact billing cycles will be published upon our official commercial release.

7. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Pastel makes no representations or warranties of any kind, express or implied, regarding the accuracy, reliability, or completeness of the social intent data provided.

We do not guarantee any specific sales results, pipeline generation, or revenue increases from using the service.

8. Limitation of Liability

In no event shall PASTEL SASU, its directors, employees, or agents be liable for any indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, or loss of data arising from your use of the Service.

Our total liability to you for any cause whatsoever will at all times be limited to the amount paid by you to us during the six (6) months prior to any cause of action arising.

9. Indemnification

You agree to defend, indemnify, and hold PASTEL SASU harmless from any claims, liabilities, damages, judgments, and expenses (including attorney's fees) arising out of your violation of these Terms of Use or your misuse of the data provided by the Service.

10. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of these Terms.

11. Governing Law & Jurisdiction

These Terms and Conditions and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of France.

Any legal action or proceeding relating to these terms shall be instituted exclusively in the competent courts located in Paris, France.
